TRUSTEE MEETING 12-10-11 VIDEO 8 (0:10-2:04) PROPERTY OWNER: This may be a question for Baylard, and@or Tom, if we were barred from here and we were walking to our property, can we still be arrested for trespassing? ATTORNEY DAVE BAYLARD: No, sir. OFFICER TOM COLYOTT: I won't do it, no. PROPERTY OWNER: Well, the officer- OFFICER TOM COLYOTT: (Inaudible) PROPERTY OWNER: One of the officers that showed up on the last incident, they were told that they would be arrested for trespassing if the board wanted it to happen. OFFICER TOM COLYOTT: May I ask where you were at when that happened, because I was on vacation. PROPERTY OWNER: We were all up at the front gate. OFFICER TOM COLYOTT: At the front gate, you're on Trusteeship property. You're not on your private property. If they ask you to leave, you need to leave. PROPERTY OWNER: But, I understand that. They were going to leave like they were told to, but they were also told if they were walking to their property, although they were banned from common ground, they would still get arrested if the Board of Trustees told them to. ATTORNEY DAVE BAYLARD: That's not true. OFFICER TOM COLYOTT: That's not true. Unfortunately, Dale, if that happened, I apologize, because that particular deputy is not familiar with the internal workings of this place. If I had been there, the response would have been different. PROPERTY OWNER: So, the officer was wrong? OFFICER TOM COLYOTT: It's very possible he was wrong. I'll have to ask him how the conversation went. I wasn't there. PROPERTY OWNER: Another question is, once you're banned from here, how long does it take to get that ban lifted? OFFICER TOM COLYOTT: It's entirely up to the people that represent the property and have pure custody and control over it and that's the Board. They make the decisions. It's just like if it was your property. You would decide when you wanted someone back on your property. PROPERTY OWNER: So, on the 140-day Rule, if you left for a week, you can't come back in?
